1. How are School Violence Measures Recorded?

In Korea, school violence measures are not intended to stigmatize students but serve as administrative records to manage guidance and educational efforts. These records do not contain lengthy descriptions or subjective evaluations; they are documented strictly within the scope required for academic management. Since these entries are governed by Ministry of Education guidelines rather than individual discretion, parents need not fear arbitrary recording. However, the retention and deletion periods vary significantly depending on the "Measure Number" assigned.

• No. 1~3: Deleted upon graduation

• No. 4~5: Deleted 2 years after graduation

• No. 6~7: Deleted 4 years after graduation

• No. 8: Retained for 4 years after graduation

• No. 9: Permanent (Cannot be deleted)

For Measures No. 4 through 7, early deletion is possible upon review by the dedicated response team just before graduation, provided there is clear evidence of reflection and behavioral change. Except for No. 9, these records are not necessarily permanent; their status can change based on the student's compliance and growth.

1. 가해학생 학폭 조치, 어떻게 기록될까?

한국에서 학폭 조치사항은 처벌이나 낙인을 위한 기록이 아니라, 선도·교육 조치의 이행을 관리하기 위한 행정 기록입니다. 사건의 세부 경과나 평가가 장황하게 적히는 구조는 아니고, 조치 결과와 학적 관리에 필요한 범위에서만 기록됩니다. 또 학교 담당자의 재량이나 감정으로 작성되지 않고, 교육부 가이드에 따라 엄격한 원칙과 절차 속에서 관리되니 막연히 불안해하시지 않아도 됩니다.

다만 조치번호에 따라 기록 유지·삭제 기준과 시점이 달라집니다.

• 1·2·3호 조치: 졸업과 동시에 삭제

• 4·5호 조치: 졸업일로부터 2년 후 삭제

• 6·7호 조치: 졸업일로부터 4년 후 삭제

• 8호 조치: 졸업 후 4년 보존

• 9호 조치: 삭제 불가

4~7호 조치의 경우 반성 정도와 실제 행동 변화가 확인되면 졸업 직전 전담기구 심의를 거쳐 조기 삭제가 가능합니다. 9호 조치를 제외하고는 학폭 기록은 ‘한 번 기록되면 끝’이 아니라, 조치 이후의 이행과 관리에 따라 달라질 수 있는 구조입니다.

2. "Conditional Suspension of Entry" for Measures No. 1–3

In principle, Measures No. 1 (Written Apology), No. 2 (No Contact), and No. 3 (School Service) are subject to a "Conditional Suspension of Entry." This system allows the school to withhold the record from the student file if certain requirements are met. It serves as a second chance, but this suspension is revoked in the following cases:

• Non-compliance: Failing to submit an apology or complete service within the period set by the Committee.

• Recidivism: If the student is subjected to another school violence measure while at the same school level, previous No. 1–3 records will be entered simultaneously.

• Failed Litigation: If an entry was suspended due to a court-ordered stay of execution, but the student ultimately loses the lawsuit without completing the original measure.

2. 1~3호 조치, ‘조건부 기재유보’의 의미

원칙적으로는 생기부 기재 대상인 1호(서면사과), 2호(접촉 금지), 3호(학교 봉사) 조치에 대해 일정 요건을 충족할 경우 기재를 미뤄주는 제도가 있습니다. 조건부 기재유보인데요. 생기부에 남지 않을 기회를 주는 장치이지만, 다음과 같은 예외적인 경우에는 기재유보가 적용되지 않습니다.

• 조치 미이행: 심의위원회가 정한 기간 내에 사과문 제출이나 봉사 활동을 하지 않은 경우

• 동일 학교급 내 재발: 재학하는 동안 다시 학폭 조치를 받게 되면, 이전의 1~3호 기록까지 함께 생기부에 기재

• 집행정지 후 패소 시 조치 미완료: 법원으로부터 집행정지(효력정지) 결정을 받은 경우, 집행정지 기간 동안은 생기부 기재가 보류. 최종적으로 소송에서 패소하면 조치 완료 여부에 따라 기재여부 결정

3. Not All Measures Leave a Mark on the Student Record

It is important to note that not every action related to a school violence case appears in the permanent record:

• Protective measures for the victim are never recorded in their student file.

• Immediate protection orders (e.g., prohibition of contact or threats) are excluded from the record.

• Completion of special education or psychological therapy by the perpetrator (related to Measures 2-4, 6-8) is also not recorded.

Furthermore, as of 2024, school violence records are no longer scattered across various sections but are unified under a single dedicated category: "School Violence Measure Management."

3. 모든 학폭 조치가 생기부에 남는 것은 아닙니다

모든 학폭 조치가 생기부에 기록되는 것은 아닙니다.

• 당연히 피해학생의 보호 조치는 생기부에 기재되지 않습니다.

• 접촉·협박·보복행위 금지 조치는 즉시 보호 목적 조치로 기재하지 않습니다.

• 2~4, 6~8호 처분을 받은 가해학생의 특별교육·심리치료 이수 사실도 생기부에 남지 않습니다.

또한 학폭위가 열리기 전에 학교장이 필요에 의해 내렸던 긴급조치는 이후 학폭위에서 추인된 경우에만 생기부에 반영됩니다. 또 2024년부터는 학폭 기록이 여러 항목에 흩어져 적히지 않고, ‘학교폭력 조치 상황관리’ 항목으로 일원화되어 관리됩니다.

4. Consequences of Failing to Comply with Measures

Compliance within the designated timeframe is mandatory. If a student fails to comply, the school will issue reminders; continued non-compliance is reported to the District Office of Education. The Committee will then review the reasons and may determine additional measures.

• Violating "No Contact" orders: This can be treated as a new incident of school violence, triggering a fresh procedure.

• Failing Service or Education: This leads to a reassessment of the student's status and may impact attendance records or behavioral evaluations.

Measures No. 1–3, compliance is especially vital to secure the benefit of the suspended entry. Since non-compliance can negatively affect attendance and behavioral records, it is highly recommended to seek professional guidance if there are practical difficulties in fulfilling the measures.

4.학폭 조치를 이행하지 않으면 어떻게 될까?

학폭 조치는 정해진 기간 내 이행하는 것이 원칙입니다. 이행하지 않으면 학교는 먼저 안내·독촉을 하고, 상당 기간 미이행 시 교육지원청에 보고하게 됩니다. 이후 심의위원회는 미이행 사유를 검토해 추가 조치 여부를 판단할 수 있습니다. 특히,

• 접촉·보복 금지 조치를 위반하면 → 새로운 학폭 사안으로 다시 절차가 시작될 수 있고

• 봉사·특별교육·출석정지 등을 이행하지 않으면 → 다시 판단 대상이 됩니다

1~3호 조치의 경우, 일정 요건을 충족하면 위에 말씀드린 조건부 기재유보를 적용해주는데 이를 거부해 굳이 불이익으로 남길 이유가 없지요. 또 출석정지, 학교봉사, 사회봉사, 특별교육처럼 학생의 일상적인 학교생활과 바로 연결되는 조치들의 경우, 이행하지 않으면 학교 출결 처리와 생활지도 기록에 문제가 생길 수 있어 주의해야 합니다.

학교 측에서는 보통 이행을 유도하고 상황을 정리하는 절차를 먼저 거치고, 필요한 경우 학부모와 소통하면서 방향을 조율하기 때문에, 조치 이행이 어려운 상황이라면 적극적으로 학교와 전문가의 도움을 받으시기를 권합니다.

5. Focus on What You Can Control Now

Once the Committee reaches a decision, the focus shifts to long-term management. Even if the child is struggling emotionally or if the measures are difficult to implement immediately, staying passive is the worst strategy. There is a profound procedural difference between "ignoring an order" and "navigating the order through adjustment."
